By entering Summit Gaming Lounge premises, using our gaming equipment, participating in our events, or accessing our website, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after any changes constitutes acceptance of the new Terms.

2. Facility Usage and Conduct

All users must follow our facility rules and guidelines to ensure a safe and enjoyable environment for everyone. Users are expected to treat all equipment, furniture, and facilities with respect and care. Any intentional damage to our property will result in charges for repair or replacement costs.

Inappropriate behavior, including but not limited to harassment, discrimination, excessive noise, or disruptive conduct, will not be tolerated and may result in immediate removal from the premises without refund. We maintain the right to refuse service to anyone who violates our conduct policies.

All users must comply with age restrictions for certain games and areas within our facility. Minors under 16 must be accompanied by a parent or guardian, and those under 18 require parental consent for certain activities and tournaments.

3. Gaming Equipment and Services

Our gaming equipment is provided for your enjoyment and use during your visit. Users are responsible for any damage caused by misuse, negligence, or intentional harm to our equipment. We reserve the right to charge users for repairs or replacement of damaged equipment.

Gaming sessions are subject to availability and our operating hours. We do not guarantee the availability of specific games, equipment, or services at any given time. Technical issues or maintenance may occasionally interrupt service, and we will not be liable for any inconvenience caused.

Personal gaming accounts, progress, and data are the user's responsibility. Summit Gaming Lounge is not responsible for lost game progress, account issues, or data loss that may occur during your gaming session.

4. Payment and Pricing

All prices are subject to change without notice. Payment is required in advance for gaming sessions, events, and services. We accept various payment methods including credit cards, debit cards, and cash. All payments are in Canadian dollars unless otherwise specified.

Refunds are generally not provided except in cases of facility closure due to circumstances beyond our control. Session time begins when reserved equipment becomes available to you, regardless of when you begin using it. Unused time cannot be transferred or refunded.

Group bookings, private events, and tournament fees are subject to specific terms and conditions that will be provided at the time of booking. Cancellation policies may vary depending on the type of service or event.

5. Privacy and Data Protection

We are committed to protecting your privacy and personal information. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we handle your information.

6. Tournament and Event Participation

Participation in tournaments and events is subject to additional rules and regulations that will be provided at the time of registration. All participants must agree to abide by tournament-specific rules, game rules, and our general conduct policies.

Tournament prizes and awards are subject to the terms and conditions of each specific event. Winners may be required to provide identification and other information for tax and legal purposes. Prizes have no cash value unless specifically stated.

We reserve the right to disqualify participants who violate tournament rules, engage in unsportsmanlike conduct, or use unauthorized software or modifications. Decisions made by tournament officials are final.

7. Intellectual Property

All content on our website and within our facility, including but not limited to text, graphics, logos, images, and software, is the property of Summit Gaming Lounge or our licensors and is protected by copyright and other intellectual property laws.

Users may not reproduce, distribute, modify, or create derivative works of our content without express written permission. The games and software available at our facility are licensed products, and users must comply with all applicable license agreements.

8. Limitation of Liability

Summit Gaming Lounge provides services "as is" and makes no warranties, express or implied, regarding the quality, availability, or suitability of our services. We do not guarantee uninterrupted or error-free service, and technical issues may occasionally occur.

To the maximum extent permitted by law, Summit Gaming Lounge shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses resulting from your use of our services.

Our total liability for any claim related to our services shall not exceed the amount you paid for the specific service giving rise to the claim. Some jurisdictions do not allow the limitation of certain damages, so some of these limitations may not apply to you.

9. Health and Safety

Users participate in gaming activities at their own risk. We recommend taking regular breaks during extended gaming sessions to prevent eye strain, repetitive stress injuries, and other health issues associated with prolonged computer use.

Users with medical conditions that may be affected by gaming activities, including but not limited to epilepsy, heart conditions, or repetitive stress injuries, should consult with a healthcare provider before using our services.

We maintain safety protocols and emergency procedures, but users are responsible for their own safety and the safety of others around them. Please report any safety concerns or incidents to our staff immediately.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles. Any disputes arising from these Terms or your use of our services shall be resolved through binding arbitration in accordance with the rules of the Ontario Arbitration Act.

Before pursuing arbitration, parties agree to first attempt to resolve disputes through good faith negotiations. If arbitration is necessary, it will be conducted in Toronto, Ontario, and the decision of the arbitrator will be final and binding.
